THE PAYMENT OF THE MORTGAGE TAX TO THE BANKING.
At the last hour of October 19, 2018, the Judiciary reported something never seen inside the Supreme Court. Paralyzed the effects of the ruling of the Litigation Chamber of the TS issued on 10/16/2018 by changing the criteria to be followed, establishing that who should pay the tax on legal acts documented in public deeds with mortgage guarantee is the lender, and not who receives the loan.
According to the Judiciary, the Plenary of the Third Chamber of the TS will decide if it confirms the jurisprudential turn of the judgment on the tax on mortgages.
After hearing this news, on Monday, October 22, the President of the High Court met with the magistrates who dictated the controversial judgment to analyze the situation created and it is reported that next Monday, November 5, there will be a plenary meeting of the Chamber of the Contentious-Administrative to decide the future of the payment of the tax.
