TO DISMISS A WORKER, IS IT NECESSARY TO NOTIFY HIM?

01/02/2022

It depends on the dismissal that is applied to you in the specific case. If it is a disciplinary dismissal, no prior notice is required. For the rest of the dismissals, it must be done fifteen days in advance (unless another period is established in the Collective Agreement). Failure to notify the worker will be compensated for the legally established days.

IF IT IS THE WORKER WHO CAUSES VOLUNTARY LEAVE IN THE COMPANY, SHOULD I BE NOTIFIED?

Yes, notice in these cases is mandatory. The general rule is fifteen days, however, in the Collective Agreement the notice for each category will be established.
