THE SUPREME COURT DECIDES BY TWO VOTES THAT THE CUSTOMER PAY THE TAX

08/11/2018

The Supreme Court yesterday reversed: the tax on mortgages has to be paid by the client.

The plenary of the Contentious-Administrative Chamber took the
final decision after two days of intense debate and by only two votes of difference: 15 judges in favor of paying the client and 13 of maintaining the criteria set on October 16, which changed the case law of the high court so that the tribute was paid by the banks.
