NEW DEADLINE FOR HOLDING MEETINGS OF OWNERS DECEMBER 31, 2021
Decree Law 53/2020, of 22 December, amending Decree Law 10/2020, of 27 March, establishing new extraordinary measures to deal with the health, economic and social impact of COVID-19 . DOGC no. 8303 of 24/12/2020.
This Decree Law 53/2020 enters into force on December 24, 2020.
The only change made refers to the deadline for compliance with the obligation to convene and hold meetings of owners in communities subject to horizontal ownership, which remains suspended until December 31, 2021 (until now, it was suspended until April 30, 2021).
- Meetings may be held by the means established in art. 312-5.2 of the CCCat, that is, by videoconference or other means of communication, as long as the identity of the attendees, the continuity of communication and the possibility of intervening in the deliberations and in the issuance of the vote are guaranteed.
- Until the next Ordinary Meeting is convened and held, resolutions may also continue to be adopted without a meeting at the request of the Presidency and comply with the following requirements (art. 312-7 of the CCCat):
-Issue of the vote by post, telematic communication or any other means that guarantees the right to information and vote. I,
- That the receipt of the vote is recorded and its authenticity is guaranteed.
