On June 5, 2010, an agent from the Local Police was presented to the farm of the recurrent where some works were being carried out for the extension of a porch. After verifying that everything was in order, the agent observed that an excavator had started a large ash that was on the ground, next to the house, and opened a sanctioning file ascertaining that he did not have a license to do it. ho
The recurrent alleged that the tree was dry and that architects were advised to cut it for security reasons. However, the Board of Governors, dated April 26, 2011, imposed that sanction for the commission of a very serious infringement foreseen in the law of protection and promotion of the urban landscape of the Community of Madrid .
The administrative dispute number 24 in Madrid and the TSJM confirmed the fine.
